Henry Preston's Bond of Debt to William Kneale

Part 1 — the bond

Know all men by these presents that Henry Preston of the Town of Ramsey doth
hereby own and acknowledge himself to be and stand justly indebted
unto William Kneale of Bolwvia[?] Cottage near Ramsey in the full and
just sum of Two Hundred pounds. To the repayment whereof with
interest thereon at and after the rate of Four pounds ten shillings per cent
per annum and all costs and charges attending these presents, the said
Henry Preston hereby binds and obliges himself his heirs ex[ecuto]rs and
adm[inistrato]rs firmly by these presents. And for the further and better
security of the said William Kneale in the premises Further Know
Ye that the said Henry Preston by and with the consent of Ann
Preston his wife testified by her becoming an executing party hereto
Have given granted passed over and secured and by these presents
Do give grant pass over and secure to the said William Kneale
all and singular the whole of the lands and buildings and
premises situate in Santon belonging to the late Charles Moore
of Santon and which were recently purchased by the said
Henry Preston from George Henry Wood Coroner of Middle Sheading
and which said premises are more particularly bounded
and described in the said deed of sale from G.H. Wood to the
said Henry Preston and bearing equal date herewith the 2nd July 1870

Part 2 — continued, and signatures

Have and To Hold the said lands buildings and premises
described as aforesaid, together with all rights and appurtenances
to the same in anywise belonging to the said William Kneale
his ex[ecuto]rs, adm[inistrato]rs and assigns in security until repayment of
the said principal sum of Two Hundred pounds with all interest
costs and charges. And it is agreed upon by and between the
parties hereto that six months notice must be given before
the principal money of this deed can be called in or paid off

At Douglas 16 Aug: 1870 — William Isdale, one of the Witnesses to the foregoing deed, who is known to me, made oath that Henry Preston and Ann Preston the parties thereto duly affixed their marks thereto after the same had been duly read over to them in presence of deponent and of Wm Hampton and Thos Morrison the other executing parties thereto.

Notes on Parts 1–2

• "Bolwvia Cottage," William Kneale's residence near Ramsey, is difficult to make out with confidence and may not be correctly resolved.
• The date of execution was corrected in the manuscript: "September" struck through and "August" written above, so the bond is dated 16 August 1870.
• The land pledged as security is the same Santon property (bought from George Henry Wood, deed dated 2 July 1870) that appears in Henry Preston's Conveyance and Trust deed of 20 August 1870 — this bond to William Kneale was evidently still outstanding against that land when it was placed in trust for William Isdale four days later.
• William Isdale, the same man named as trustee/purchaser in the Conveyance and Trust deed, appears here only as a witness, and later gave the oath confirming the Prestons' marks.

Part 3 — Registry Office certificate

Registry Office 16th August 1870 — I certify that the foregoing Deed was this day at the hour of Two o'clock afternoon received by me at this Office for the purpose of being registered and recorded according to Law and that the same is duly registered and recorded and entered in the requisition book 7 page 142 No 1841 — J[oh]n [?] Harris, Reg[istrar]

Part 4 — Discharge and cancellation, 29 December 1894

Whereas M[iste]r Henry Preston of Santon dec[ease]d did on the 16th day of August 1870, grant and pass his deed of Bond and Security to M[iste]r William Kneale of Bolwvia Cottage Ramsey for the principal sum of Two Hundred pounds and secured upon all and singular certain lands and premises situate in the parish of Santon.

And Whereas the said William Kneale has since died leaving a Will of which he appointed his wife Executrix. And Whereas M[r]s Jane Kneale the widow renounced the Executorship. And Whereas M[iste]r Edw[ar]d Quine of Ballalig in Braddan was duly appointed as Administrator with the Will annexed.

Now Therefore Know all men by these Presents that the said Edward Quine in his capacity as aforesaid doth hereby own and acknowledge to have received and been fully paid by William Isdale of Douglas, Trustee of the Estate of Henry Preston dec[ease]d, the full amount due for principal, interest, and all costs and charges due and owing in respect of the said Bond for Two Hundred pounds. And he doth hereby order and direct that the said deed dated as aforesaid may be and stand cancelled upon record. As Witness his name this 29 Dec[embe]r 1894 — Edward Quine.

Witnessed by [Thos?] Kelly, Broadway, Douglas. At Douglas 29 December 1894, Thomas P. Kelly, the witness to the foregoing deed, who is known to me, made Oath that Edward Quine the executing party thereto duly signed the same in his presence.

Notes on Parts 3–4

• The 1870 Registry certificate confirms this bond was registered the same day it was signed, 16 August 1870 (Book 7, Page 142, No. 1841).
• The 1894 discharge is a highly significant find. It confirms that Henry Preston had died by 1894 (consistent with his will being proved in 1875), and it traces William Kneale's own death and the passage of his estate: his widow Jane Kneale was appointed executrix under his will but renounced that role, and Edward Quine of Ballalig, Braddan, was appointed administrator with the will annexed in her place. Twenty-four years after the original loan, Edward Quine acknowledges the £200 debt was paid in full — not by Henry Preston himself, but by William Isdale of Douglas, "Trustee of the Estate of Henry Preston deceased." This directly confirms William Isdale was still acting as trustee in 1894.

Summary

On 16 August 1870, Henry Preston of Ramsey, with his wife Ann's consent, acknowledged a debt of £200 owed to William Kneale of Bolwvia[?] Cottage near Ramsey, at 4½% annual interest, secured on the same Santon land Henry had recently bought — the same land placed in trust for William Isdale four days later. On 29 December 1894, Edward Quine of Ballalig, Braddan — appointed administrator of the late William Kneale's estate after Kneale's widow Jane renounced the executorship — formally acknowledged the £200 debt had been paid in full by William Isdale, "Trustee of the Estate of Henry Preston deceased," and ordered the bond cancelled. This confirms Henry Preston had died by this date, and that William Isdale was still administering the 1870 trust nearly a quarter of a century later.
